Eligibility: Open to legal residents of the 50 United States and D.C., who are 18 years of age or older as of date of entry (“Entrant”). Employees of Arrived Homes (“Sponsor”), Don Jagoda Associates, Inc., and any of their affiliates, parents, subsidiaries, prize providers, and advertising and Contest agencies associated with the Contest (collectively, “Contest Entities”), and members of their immediate family members (spouses, parents, children, and siblings and their spouses), and/or those living in the same household of each such employees are not eligible. Void where prohibited or restricted by law. Subject to all applicable federal, state, and local laws, ordinances and regulations. By entering the Contest, Entrants accept and agree to be bound by these Official Rules.
How to Enter: During the Contest Period, visit arrivedhomes.com (“Website”) and follow the on-screen instructions to submit your entry, by providing your contact information, and your best, wildest and most unique vacation rental design. Include the property theme, interior layout and decoration, including your name and description for your design. You may include any supporting documents that help Sponsor to visualize and understand the design/layout (collectively, “Entry”). You may be asked to schedule a video call with an Arrived team member to discuss your submission in more detail prior to moving on to the judging phase. In the event another contest of this type is run by Sponsor in the future, your Entry (if not determined the winner) will be automatically included in the judging process for any subsequent contests.
Entries and Interviews, further defined below, must adhere to the Guidelines indicated below, as determined by Sponsor/Administrator in their sole discretion. Sponsor has the final determination if any Entry/Interview complies with the Guidelines.
Guidelines:
- Entry must be in English and must meet the parameters on the Website.
- There is no limit on the amount of Entries an Entrant may submit but each Entry submitted must be unique.
- Entry must be your original idea (modification of an original work is not an original idea). Entries must not copy or otherwise plagiarize from any source.
- The Entry must not contain content that is known by you to be false, inaccurate or misleading.
- Any Entry deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified. Entries must not contain material that is inappropriate, indecent (including, but not limited to, nudity, or pornography), profane, obscene, hateful, tortious, defamatory, slanderous, libelous (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group), violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), or illegal (e.g., underage drinking, substance abuse, computer hacking, etc.).
- Entry must not contain any content that infringes or may infringe third party rights, including, without limitation, any copyright, name, trademark, logo, trade dress, or other personal or proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity or make reference to any commercial/corporate advertising (including but not limited to corporate logos, brand names, charities, slogans, political, or religious statements), or be otherwise objectionable. Without limiting the generality of the foregoing, publicly displayed and publicly accessible Sponsor content or materials are permitted to be displayed in Entries submitted for this Contest.
- Entries must not include music protected by a copyright (but including music that you own or have the rights to use is permitted).
- Any clothing shown in an Entry should not contain any visible logos, drawings, cartoons, phrases, trademarks or other third-party content or materials.
- The Entry must not include any representation of celebrities, athletes, musicians, or any other third-party (public or private), include any anti-social, political or religious groups, any commercial solicitation or promotional materials or name, address, phone number, or URL address. Entries must not contain advertisements, personal solicitations or commercial solicitations.
- All submitted Entries must be in keeping with Sponsor’s image as determined by Sponsor, in its sole discretion, or entry will be disqualified from the Contest. The Entry must not disparage persons or organizations associated with Sponsor.
- Entries must not depict or reference any of Sponsor’s competitors or competitor’s products.
By entering, you represent and warrant that you have fully complied and are in agreement with these Official Rules. The information you provide will only be used in connection with this Contest or in connection with promotional or other activities of Sponsor. All Entries become the sole property of the Sponsor and will not be returned. Receipt of Entries may be acknowledged, but such acknowledgment is not binding upon Sponsor or Administrator.
Normal internet access and usage charges imposed by Entrants’ online service may apply and are Entrants’ sole responsibility. If entering via mobile device, normal phone/data and usage charges imposed by your phone service may apply and are Entrant’s sole responsibility. Use of computer programs and other automatic means to participate is prohibited. The use of script, macro or automated devices (or any other devices intended to automate or subvert any aspect of participation) to enter is prohibited. If Sponsor, in its sole discretion, determines that an Entrant has used an automated or similar device to enter or is otherwise in violation of these Official Rules, all Entries received by that Entrant will be void.
Each Entrant grants to the Contest Entities a worldwide, royalty-free, perpetual, non-exclusive right and license to copy, distribute, and display each submitted Entry (and subsequent Interview, if applicable), in any media, and with right to use, copy, modify, edit, and create derivative works therefrom, and agrees to execute documents confirming such right and license at Sponsor’s reasonable request. By entering, you understand that your Entry may be featured in Sponsor’s social media channels or other advertising, in Sponsor’s sole discretion, to be viewed by members of the general public for public viewing now or in the future, in their sole discretion. By entering, each Entrant warrants and represents that his/her Entry is original, has not been previously published or won any award, does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, including patents, copyrights, trademarks or rights of privacy or publicity, and will not violate any federal, state or local laws or ordinances. Sponsor reserves the right in its sole and unfettered discretion to disqualify any Entry that it believes does not comply with these Official Rules or that is not consistent with the spirit or theme of the Contest. No information regarding Entries/Interviews/judging, other than as otherwise set forth in these Official Rules will be disclosed.
Finalist Judging: All eligible Entries received during the Contest Period will be judged by the Sponsor and its agents to determine five (5) Finalists (each, a “Finalist”). Entries will be judged based on the following criteria (“Criteria”): Creativity – 33%; Desirability – 33%; Feasibility – 34%. Sponsor will not reveal details relating to the judging process. In the event of a tie, judges will make the final determination based 100% on Feasibility.
Finalist/Grand Prize Notification/Verification: The potential Finalists will be contacted via email and will be required to complete and return a Declaration of Eligibility, Release of Liability and a Publicity Release (where legal) and an Assignment of Rights within 48 hours of notification attempt. Non-compliance within this time period or return of any notification as undeliverable may result in disqualification and determination of an alternate Finalist. Sponsor reserves the right to conduct a background check on the Finalists (and each Finalist agrees to this) and reserves the right in its sole discretion to disqualify the Finalist based on the results of such background check(s), if Sponsor determines in its sole discretion that awarding a prize to such Finalist might reflect negatively on Sponsor or Contest Entities. Grand Prize winner, once determined must complete and return a Grand Prize Acceptance Form within the time specified or prize may be forfeited and an alternate will be determined from the next highest scoring Finalist. Finalists and Grand Prize winner are subject to verification by Sponsor and/or Administrator whose decisions are final and binding in all matters relating to this Contest.
Grand Prize Determination: After an eligible Entrant is confirmed as a Finalist (as described above), they will be required to participate in a Sponsor-specified live interview (“Interview”) to be conducted virtually by a panel of judges, as part of the final judging process. Scheduling for said Interview will be confirmed via the Declaration of Compliance and will be due upon receipt. As part of the confirmation process, Finalists will be expected to provide a release for the content of this Interview. The Finalists’ Interviews will be judged based on the same Criteria to determine the Grand Prize winner. All details of the Interview will be provided to Finalists once verified. In the event of a tie to determine Grand Prize winner, tied Finalist Entries will be re-judged based on (100%) Creativity.
Prize: One (1) Grand Prize: Winner’s design will be brought to real life in one of Sponsor’s vacation rental properties (by their property management partners), including naming rights (that must follow the Arrived property naming convention and is not objectionable) and winner will receive $5,000 worth of Arrived shares through a redeemable code and transferred by Sponsor to the winner when it launches on Sponsor’s platform, based on winner’s Entry. There is no retail value associated with design or naming rights, only the winner’s shares. Winner must have an Arrived Home account.
Prize Restrictions: All federal, state and local taxes, and all other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winner. Grand Prize winner will be issued a 1099 Tax form for the value of the prize won. Prize is not redeemable for cash.
General Rules: Incomplete, corrupted, or untimely Entries are void and will be disqualified. Contest Entities are not responsible for lost, late, incomplete, damaged or misdirected Entries/Finalist/winner notification documents; lost, interrupted, or unavailable network, server, or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user’s computer/phone equipment (software or hardware), or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Proof of Entry will not be deemed to be proof of receipt by Sponsor. Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion, and in the event of cancellation, the Finalists will be determined from the eligible Entries received prior to cancellation based on the Criteria. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW; SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right at its sole discretion to disqualify any individual it finds: to be attempting to tamper with or undermine the entry/judging/Interview process, and/or the legitimate operation of the Contest; to violate the Official Rules; or, to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Contest is not capable of running as planned by reason of pandemic, strikes, natural disasters or any other factors beyond Sponsor’s reasonable control that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor may, in its sole discretion, void any suspect entries and (a) modify the Contest or suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b)determine Finalists from the eligible Entries received prior to cancellation based on the Criteria.
Warranties and Representations; Release of Liability: You hereby hold each of the Contest Entities and each of their respective officers, directors, members, managers, employees, agents, representatives, successors and assigns (the “Released Parties”) harmless from and against any third-party claim arising from use of any Entry/Interview and you waive any right to inspect or approve uses of your Entry/Interview by Sponsor in connection with the Contest or to be compensated for any such uses. Participating in the Contest constitutes permission to the Sponsor to use Finalists’/winner’s name, address, and likeness in connection with the administration of the Contest only and as otherwise required by law. By participating in the Contest, the Entrant agrees that Released Parties will have no liability whatsoever for, and will be held harmless by Entrant for any liability for any bodily injury, loss or damages of any kind to persons, including death, and property, due in whole or in part, directly or indirectly, from Entry/Interview, the acceptance, possession, use or misuse of prize or component thereof, if applicable, or participation in the Contest or participation in any Contest related activity. You hereby represent and warrant that you have read these Official Rules and are fully familiar with their contents and agree to be bound by them.
Disputes: ENTRANTS/WINNER AGREE THAT: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THE CONTEST OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF ARIZONA, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER LAWS. Entrants/winner are solely responsible for compliance with all applicable laws, rules and regulations including but not limited to tax and similar reporting obligations imposed by federal, state and local authorities. As a condition of participating in the Contest, each Entrant/winner agrees that in any and all disputes that cannot be resolved between the parties and in any causes of action arising out of or connected with the Contest, the exclusive procedure for resolving the dispute shall be arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules before one arbitrator in the state of Arizona. Judgment on the award rendered by the arbitrator may be entered in any court with jurisdiction. The arbitrator shall be selected from the AAA’s large, complex case panel. Absent good cause or the parties’ agreement, the award shall be rendered within six months of the arbitrator’s selection. The arbitrator shall award reasonable attorneys’ fees and costs to the prevailing party. Except as may be required by law, neither party nor the arbitrator may disclose the existence, contents, or results of anything related to the arbitration, including but not limited to pleadings, motions, briefs, discovery, depositions, hearings, or award without all the parties’ prior written consent. The only exception to the exclusive procedure of arbitration is that either party may bring in court an action for injunctive relief pending arbitration. Each party consents to personal jurisdiction and venue in the state or federal courts in Arizona, which shall be the exclusive venue for any court action between the parties.
FURTHER, IN ANY SUCH DISPUTE, UNDER NO CIRCUMSTANCES WILL ENTRANT/WINNER BE PERMITTED TO OBTAIN AWARDS FOR AND HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE; INCIDENTAL; OR CONSEQUENTIAL DAMAGES, INCLUDING REASONABLE ATTORNEYS’ FEES, AND ENTRANT/WINNER FURTHER WAIVES ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED.
Data Collection: Sponsor collects personal information from Entrants when they enter the Contest (and for when they may be deemed a Finalist or the winner of the Contest) for use in administration of the Contest. The information collected is subject to the Privacy Policy located at https://arrived.com/privacy-policy.
